1. Scope of Services
Cosy Nepal™ is a registered hospitality trademark.
Accommodation services under the Cosy Nepal brand are provided in Nepal by locally registered companies, including but not limited to Patan Accommodation Pvt. Ltd. and Cosy Patan Experience Pvt. Ltd. (the “Accommodation Providers”).
These companies are solely responsible for accommodation services, guest experience, on-site operations, property management, maintenance, and compliance with local regulations.
The CosyNepal.com website and its online booking system are operated by Swotha OÜ, Estonia (the “Platform Operator”).
Swotha OÜ does not own, manage or operate accommodation properties and does not provide lodging services.
2. Booking & Payments
All reservations require a deposit to secure the booking.
Online deposit payments are processed in EUR through the booking platform operated by Swotha OÜ, acting solely as a technical platform operator and payment processor on behalf of the Accommodation Providers.
Prices may be displayed in USD for convenience. Currency conversion and any related fees are handled by the guest’s bank or card provider.
The remaining balance may be paid online or upon arrival in Nepal, depending on guest preference and property policy.
The official accommodation invoice is issued exclusively by the relevant Accommodation Provider at check-in.
3. Cancellations & Modifications
The deposit is non-refundable but fully deductible from the final accommodation bill.
Date changes or booking modifications are subject to availability and may incur additional charges.
Detailed cancellation terms are provided in the applicable Cancellation Policy communicated at the time of booking.
4. Liability & Responsibility
Each Accommodation Provider is solely responsible for the condition, management, and delivery of the accommodation and related services.
Swotha OÜ acts solely as a platform and payment service provider and bears no responsibility for accommodation services, guest stays, on-site operations, or local service delivery.
Any claims related to accommodation quality, guest experience, or on-site incidents must be addressed directly to the relevant Accommodation Provider.
5. Guest Responsibilities
Guests agree to respect house rules, local customs, and the properties they stay in.
Any damage, loss, or breach of house rules may result in additional charges, as determined by the Accommodation Provider.
6. Data Protection & Privacy
Personal data collected through CosyNepal.com is processed by Swotha OÜ for booking management, payment processing, and guest communication purposes.
Relevant guest information may be shared with the Accommodation Provider solely to enable delivery of the booked accommodation services.
Data processing is carried out in accordance with applicable data protection laws and regulations.
7. Governing Law
Accommodation services and guest stays are governed by the laws of Nepal.
The operation of the booking platform, online payment processing, and related administrative services provided by Swotha OÜ are governed by the laws of Estonia.
